AI uses this information to generate brand positioning, strategy recommendations, content ideas, social media captions, scripts, campaign plans, calendar suggestions, feed insights, marketing recommendations, and performance summaries.

You should not submit sensitive personal data, confidential third-party data, financial secrets, medical records, government identification numbers, or highly sensitive information into AI prompts unless the platform explicitly supports such processing and you have the right to provide that data.

5. Ownership of Content

You retain ownership of the content you upload, create, or generate through Brainiark Marketing OS, including brand information, strategies, content drafts, captions, campaigns, images, videos, uploaded documents, saved ideas, and content calendars.

By using the platform, you grant Brainiark Technologies a limited license to process, store, display, modify, transmit, and use your content solely as necessary to provide the service, operate AI features, support collaboration, enable integrations, and improve platform functionality.

We do not sell your private workspace content to third parties.

6. Social Media Integrations

When you connect a social media account, you authorize Brainiark Marketing OS to access certain data from that platform based on the permissions you approve.

This may allow us to display your posts, retrieve analytics, schedule or publish content where supported, sync account status, show platform feeds, track content performance, provide AI insights, and alert you about connection issues.

You may disconnect social accounts at any time from your account settings or social connection settings. If you disconnect a platform, we may stop collecting new data from that platform, but previously collected data may remain in your workspace unless deleted according to our retention policies.

Your use of connected social platforms is also governed by the privacy policies and terms of those platforms.

7. Cookies and Tracking Technologies

We may use cookies, local storage, and similar technologies to keep you signed in, remember preferences, improve performance, analyze platform usage, secure user sessions, personalize your experience, and understand feature adoption.

You may be able to disable cookies through your browser settings, but some features may not work properly without them.

8. Notifications

Brainiark Marketing OS may send in-app notifications related to AI task completion, content approval, strategy updates, Brand Brain completion, feed updates, new ideas, calendar reminders, scheduling issues, social account disconnections, campaign activity, workspace activity, and system alerts.

If email, push, WhatsApp, or other notification channels are introduced, users may be able to manage their preferences through notification settings.

9. How We Share Information

We do not sell your personal information.

We may share information with trusted service providers who help us operate the platform, including cloud hosting providers, database providers, AI service providers, analytics providers, payment processors, email service providers, error monitoring tools, and social media integration providers.

If you connect social media accounts or publish or schedule content, we may exchange data with the relevant social media platform as required to provide the integration.

If you are part of a shared workspace, other authorized members of that workspace may access workspace-related data depending on their permissions.

We may disclose information if required to comply with law, respond to legal requests, protect rights and property, investigate fraud or abuse, enforce our Terms of Service, protect user safety, or prevent unauthorized access.

If Brainiark Technologies is involved in a merger, acquisition, investment, restructuring, or sale of assets, user information may be transferred as part of that transaction, subject to appropriate protections.

We retain information for as long as necessary to provide the service, comply with legal obligations, resolve disputes, enforce agreements, and support legitimate business purposes.

Account data may be retained while your account is active. Workspace data may be retained while the workspace exists. AI conversations may be retained to preserve workspace history. Social media data may be retained while connected or until deleted. Billing records may be retained as required by law. Security logs may be retained for fraud prevention and system security.

You may request deletion of your account or certain data, subject to legal and operational limitations.

11. Data Security

We use reasonable administrative, technical, and organizational measures to protect your information, including authentication controls, access restrictions, secure storage, encrypted transmission where applicable, token protection, logging and monitoring, secure API practices, and role-based access controls where available.

However, no system is completely secure. We cannot guarantee absolute security of your information. You are responsible for keeping your login credentials confidential and for using secure devices and networks.

12. Your Privacy Rights

Depending on your location, you may have certain rights over your personal information, including the right to access, correct, delete, restrict processing, object to processing, export data, withdraw consent, disconnect social media accounts, manage notification preferences, and close your account.

To exercise these rights, contact us using the details provided in this policy. We may need to verify your identity before processing certain requests.

We do not knowingly collect personal information from children. If we become aware that a child has provided personal information without appropriate consent, we may delete such information.

16. Public and Benchmark Content

The platform may allow users to add benchmark companies, competitor accounts, public social media pages, and public URLs for analysis.

Where we process public content, we do so to provide content intelligence, inspiration, feed monitoring, and AI-generated insights.

Users are responsible for ensuring that their use of third-party content complies with applicable laws, platform terms, copyright rules, and fair use principles. Brainiark Marketing OS should be used for inspiration, analysis, and original content creation, not unauthorized copying of third-party content.

17. AI Output Disclaimer

AI-generated outputs may not always be accurate, complete, original, or suitable for every use case.

Users are responsible for reviewing, editing, approving, and validating AI-generated content before publishing or using it commercially. This includes checking for accuracy, brand alignment, legal compliance, copyright concerns, advertising claims, platform policy compliance, cultural sensitivity, and factual correctness.

18. Marketing Communications

We may use your contact information to send you product updates, onboarding messages, educational content, promotional offers, or service announcements.

You may unsubscribe from marketing emails where applicable. Service-related messages, such as security alerts, billing notices, or important platform updates, may still be sent even if you opt out of marketing messages.

19. Data Deletion

You may request deletion of your account or workspace data. Upon verified request, we may delete or anonymize your personal information unless we are required to retain it for legal, security, billing, fraud prevention, or legitimate business reasons.

Deleting your account may result in loss of access to workspaces, Brand Brain, strategies, content, campaigns, social connections, feed history, ideas, AI conversations, and saved files.

20. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we may update the Last Updated date at the top of this page.

If changes are significant, we may notify you through the platform, email, or other appropriate means. Your continued use of Brainiark Marketing OS after updates means you accept the revised policy.
